2. Applicability
These General Terms and Conditions apply to the Myuras Studio website. These General Terms and Conditions are communicated to the customer before the conclusion of a contract.
3. Goods – Sale and Delivery
3.1 The description of the goods, quantity, quality, price, VAT, taxes, and shipping costs are listed on our website. Other information such as photos, illustrations, descriptions, are for reference purposes only. Myuras Studio is not bound in case of obvious errors in the offer and/or contract.
3.2 Myuras Studio reserves the right to modify or cancel the contract unilaterally. In the case of unilateral modification, the customer has the right to terminate the contract within 14 days.
3.3 Myuras Studio aims to deliver all ordered goods within the agreed delivery terms. Goods and services depend on availability. Myuras Studio will inform the customer if their order or part of it cannot be delivered. If the product or order is (partially) unavailable, Myuras Studio may deliver a substitute product of equal or higher quality or deliver a partial order. If the customer wishes to refuse the substitute product, they may exercise the right of withdrawal described in Article 4. Repeated absence of the recipient or refusal to collect the goods results in the forfeiture of the right of withdrawal or refund.
3.4 If the customer receives a damaged or defective product, or if it is not the correct product, they are invited to inform Myuras Studio through the available channels (phone, email) within 14 days of receipt. The company may request photos of the damaged or non-compliant products and will provide a refund or send a replacement product as soon as possible.
3.5 Myuras Studio will deliver the goods to the address specified by the customer in the order. The customer is invited to specify exactly where the goods should be left in case of absence.
During delivery with standard courier, Myuras Studio assumes no liability, to the extent permitted by law, for loss or damage to goods delivered in accordance with the customer’s delivery instructions.
3.7 The customer can change or cancel the order without additional charges up to the day before the start of the packaging process. In this case, write to info@myuras.com with the order details (Order number, name, etc.).
4. Right of Withdrawal
4.1 The customer has the right to cancel an order up to 14 days after receiving the goods. If you wish to exercise the right of withdrawal, write to info@myuras.com. Do not return the goods to Myuras Studio before receiving confirmation to proceed. The goods must be returned in the original packaging and to the address indicated on the receipt. Myuras Studio will refund the payment to the customer.
4.2 The direct costs of returning the product are borne by the customer.
4.3 During the withdrawal period, the customer must handle the product and its packaging with care. The customer will unpack or use the product only to the extent necessary to determine its nature, characteristics, and functioning. The underlying concept is that the customer should handle and inspect the product as if they were in a store.
4.4 The customer is liable for any reduction in the value of the product resulting from handling the product in a manner that is not in accordance with the above paragraph.
5. Prices and Payment
5.1 All prices are stated in the local currency and are correct at the time of publication. They may, however, be subject to changes.
5.2 Myuras Studio may, within the framework of the law, seek information on the customer’s ability to meet their payment obligations, as well as important facts and factors for a responsible (remote) conclusion of the contract. If Myuras Studio, based on this investigation, has good reasons not to conclude the contract, it has the right to refuse an order or request or to bind the conclusion to the fulfillment of specific obligations.
5.3 The specific obligations, as indicated in Article 5.2, include among others the obligation to pay in advance.
5.4 All prices exclude shipping costs.
5.5 Myuras Studio accepts payment for goods in various ways indicated on the website or the order form.
5.6 The customer is obliged to inform Myuras Studio immediately in case of inaccuracies in the payment details provided.
6. Warranty
6.1 Myuras Studio also guarantees the quality and/or usability of the delivered products in accordance with the provided specifications. The start date of the products and the start date of the warranty. Myuras Studio covers the costs for returning the product(s) if it accepts a warranty request from the customer and invites them to return the product. Any costs arising from unfounded warranty requests are borne by the customer.
6.2 In the following cases, the warranty cannot be enforced:
- Damage resulting from negligent, attributable, or intentional behavior;
- Misuse or improper maintenance;
- Normal wear and tear;
- Product damaged due to failure to follow the user instructions.
7. Liability
Myuras Studio is not responsible for damages resulting from personal fault, attributable acts, negligence, intentional acts, or other negligent behavior or acts of the customer, to a reasonable and fair extent.
8. Disclaimer regarding the Catalog and Website
8.1 The product range can be changed at any time. Myuras Studio will make all reasonable commercial efforts to keep the website updated; however, the information and specifications provided are intended solely for illustrative purposes and may be changed without notice. The photos on the website are generally accurate but may have slight modifications in color, shape, and size.
8.2 The website content is directed solely at individuals accessing it from geographical locations within the delivery area. Myuras Studio is not responsible for the content of linked websites.
8.3 If the customer needs clarifications or additional information on the advice or information offered on our website, they are advised to write to info@myuras.com.
9. Disputes and Complaint Procedure
9.1 Myuras Studio advises the customer to send any complaints via email to info@myuras.com. Myuras Studio will make an effort to resolve the complaint satisfactorily.
9.2 The agreements between Myuras Studio and the customer in relation to these General Terms and Conditions are exclusively subject to Italian law.
